Terms of Service

Definitions
Throughout these terms:
- "Platform" means the HyperStake website at hyperstake.bet and all related services.
- "Tools" means HyperTrack (bet tracker), HyperOdds (odds comparison and calculators), HyperRace (racing tools), HyperSlips (betting picks), and the free calculators.
- "Subscription" means your paid membership purchased through Whop.
- "Content" means the data you enter (bets, notes, preferences).
- "We" / "us" means HyperStake, operated from Adelaide, South Australia.
1. Agreement
By using HyperStake, you agree to these terms. If you don't agree, don't use the platform.
We may update these terms. If we do, we'll change the date above. Continued use after an update means you accept the new terms.
2. Eligibility
You must be at least 18 years old (or the legal gambling age in your jurisdiction) to use HyperStake.
You're responsible for making sure your use of the platform is legal where you live. HyperStake is built for Australian bettors, but we don't verify your location or the legality of gambling in your jurisdiction.
3. Accounts
When you create an account, you agree to:
- Use accurate information (especially your email, since it links to your Whop membership)
- Keep your password secure
- Not share your account or create multiple accounts
- Let us know if someone accesses your account without permission
You're responsible for everything that happens under your account.
4. Subscriptions and payments
All subscriptions are handled through Whop. Here's how it works:
- Payment is processed by Whop (not by us directly)
- Subscriptions auto-renew unless you cancel before the renewal date
- You can cancel anytime from your Whop dashboard
- Cancelling stops the next charge but keeps your access until the current period ends
- Refunds follow Whop's refund policy. We can't issue refunds directly
We may change pricing in the future. If your plan price changes, we'll let you know before your next renewal.
5. What you can do
- Track and analyse your betting with HyperTrack
- Compare odds and run EV calculations with HyperOdds
- Use the free calculators (arbitrage, bonus bet, mugging, dutching)
- View and save HyperSlip picks
- Participate in leaderboards
6. What you can't do
- Scrape, reverse-engineer, or copy the platform or its data
- Use bots or automated scripts to access HyperStake
- Resell or redistribute access to the platform
- Impersonate other users
- Try to break, overload, or exploit the platform's infrastructure
- Use HyperStake for anything illegal
Breaking these rules can result in your account being suspended or deleted.
7. Your content
The data you enter (bets, notes, preferences) belongs to you. We store and process it to provide the service. That's it.
If you use public features like leaderboards or a public profile, your username and aggregated stats (ROI, win rate) will be visible to other users.
8. Our intellectual property
The platform's code, design, logos, and branding are owned by HyperStake. You can't copy, modify, or redistribute any of it without written permission.
9. No guarantees
HyperStake is a decision-support tool, not a betting service. We don't accept bets, guarantee profits, or promise that odds data will be accurate or up-to-date. All betting decisions are yours. See Responsible Gambling.
The platform is provided "as is". We don't guarantee:
- That odds data from third-party providers will always be accurate or current
- That the platform will be available 100% of the time
- That calculations will produce profitable results
10. Liability
To the extent the law allows, we're not liable for:
- Losses from betting decisions you make using HyperStake
- Inaccurate odds or calculation errors
- Downtime, bugs, or data loss
- Unauthorised access to your account
If we are liable for something, the maximum amount is what you paid us in the 12 months before the issue arose.
11. Account deletion
You can delete your account from the Settings page. This removes your bets, profile, and preferences.
We may also suspend or delete your account if:
- You break these terms
- We believe the account is being used fraudulently
- We shut down the platform (we'd give notice first)
12. Governing law
These terms are governed by the laws of South Australia, Australia. Any disputes will be handled in South Australian courts.
13. Severability
If any part of these terms turns out to be unenforceable, the rest still applies.
